Please complete an argumentative essay response to 1 of the 5
Questions listed below. Please first read the questions carefully and
ensure you are answering exactly what is asked of you. You should aim
to write a clear and concise argumentative essay that provides a
comprehensive answer and a clear stance (i.e. agreement, opposition or
a little bit of both provided you outline your reasoning). Define and
describe any concepts or term(s) discussed (i.e. democracy, ultra vires,
sovereignty, etc.) and provide evidence to support your response. When
discussing any relevant cases make sure to briefly include what the case
was about, its outcome and relevance to your answer. When discussing
any relevant legislation make sure to include the context and a brief
description of what its application and practice has been, and/or any
specific provisions relevant to your answer.

should be indicated by use of ” “, and any use of a source should include
proper citation. As with the previous assignments, I have no preference
for which writing and citation style you employ (i.e. MLA, APA, etc.); you
may use the style of your preference and all I am looking for is correct
and consistent usage. and should be double-spaced, and submitted in
either Word or Pdf format only. You should aim for the word count to be
approximately 2000-2500 words
These are the 5 essay questions you may choose between – remember
you only have to provide an essay response to 1:
1. The Supreme Court of Canada has the ability to remedy legislation
not in compliance with the Canadian Charter of Rights and Freedoms by
striking down or modifying laws to ensure consistency. Discuss whether
this is democratic by assessing arguments in favour and against. What
difficulties, if any, exist in a democratic society in recognizing and
ensuring the maintenance and protection of individual rights
protections?
2. The Canadian Charter of Rights and Freedoms recognizes equality as a
right. Describe and define equality in two forms, formal and
substantive, and discuss why the latter is more important to ensure and
protect. Discuss the problems presented by inequitable discrimination
with reference to at least one of: a) age, b) gender, or c) sexual
orientation.
3. Delgamuukw v. British Columbia, [1997] 3 S.C.R. 1010, articulated the
framework to establish Indigenous land claims throughout Canada.
Discuss the specific requirements it sets out to prove Indigenous title
exists in a given area, and whether those requirements are justified.
4. Family matters are generally deemed private, however, there are
times when society deems it important to intervene. Describe examples
of this societal intervention and discuss whether you believe it is
important or necessary, and why (or why not)?
5. Does the Canadian (or provincial) government (or governments) have
a positive obligation to provide individuals with a basic standard of
living? Discuss with reference to section 7 of the Canadian Charter of
Rights and Freedoms.
Your essay should be organized as follows:
1. Title Page
The cover page will include reference to the question number you have
selected to address out of the choices provided; as well as the title of your
essay and your student information.
2. Introduction (approx. 200-300 words)
The introduction should briefly introduce the topic and identify the question
you have chosen to address. One well-written paragraph should establish
how you will address the topic and question and generally set a professional
tone while capturing the reader’s interest. Include a clear argumentative
thesis statement as a single sentence typically positioned at the end of the
paragraph, as well as a statement setting out at least a couple arguments
you intend to make in support of your position/thesis. If space allows you
might provide a concise roadmap of the paper; however, excessively
summarizing the paper’s contents reduces word count available for
scholarly information elsewhere in the essay.
3. Body of Essay (1600 -1900 words)
The section should consist of 3-4 paragraphs. Within those paragraphs
students must identify, provide sufficient background information for, and
succinctly summarize the issue(s) that is connected to the assigned research
question. However, these paragraphs must not simply be descriptive in
nature. Rather, you are also expected to demonstrate your analysis and
original thinking, arguing the position you have taken on the matter. To do
that, you must lay out the logic and reasoning you are relying on, and utilize
your own analytical skills, in conveying your informed judgment after
considering all sides of the issue. What your argument or position is does
not matter, so long as you have demonstrated your reasoning and analysis,
and provided sufficient supporting evidence as to why you have come to the
conclusion you have.
4. Conclusion (approx. 200-300 words)
The conclusion is a short and precise identification of what has been
learned in relation to the assigned research question. Synthesize key
information from each section to address the essay question. Conclude by
demonstrating how your stated argumentative thesis has been proven via a
concise breakdown of the supporting evidence you have expanded upon
previously.
5. Works Cited (5+ sources)
The works cited is a properly formatted alphabetical list of the publication
details of any scholarly sources referred to in the essay. These would include
books, journal articles, cases, legislation, news sources and more. Standard
presentation information is required.
